By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

EvenFieldGateway offers a variety of yacht charter services such as:

• Daily yacht rentals
• Sunset cruises
• Corporate getaways
• Private parties
• Extended charters

All services are dependent on availability and subject to weather conditions. We reserve the right to alter or cease services at any moment.

3. Booking and Reservations

3.1 Booking Process

To reserve a yacht, applicants must:

• Be at least 18 years of age
• Provide truthful and complete information
• Make the necessary deposit as detailed in the reservation confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

Bookings are confirmed only when payment is received and acknowledged by us in writing. We maintain the right to deny service to anyone for any reason.

3.3 Availability

All yacht rentals are contingent upon the availability of boats and appropriate weather conditions. We will strive to fulfill your requested dates and timing.

4. Payment Terms

4.1 Pricing

All fees are listed in € and include all applicable taxes unless indicated otherwise. Prices can be adjusted without prior notice.

4.2 Payment Schedule

• Deposit: Half of the total charter cost is due at the time of reservation
• Final Payment: Payable 48 hours prior to the charter's commencement
• Supplemental charges (if any): Payable at the end of the charter

4.3 Payment Methods

Payment can be made using major credit cards, bank wire transfers, and certified bank drafts. Our payment processing is conducted through secure and encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: Full refund minus transaction fees
• Between 24 and 72 hours prior to departure: 50% refund
• Less than 24 hours before departure: No refund provided

5.2 Weather Cancellations

Should the weather be unsafe according to our captain’s assessment, we propose to:

• Reschedule the charter to a later date at no extra cost
• Issue a full refund if a reschedule is unfeasible

5.3 Mechanical Failures

In case of mechanical issues with the assigned yacht, we will attempt to offer a comparable alternative. If this is not an option, we will provide a complete refund.

6. Safety and Conduct

6.1 Safety Measures

All guests are required to:

• Adhere to instructions given by the crew
• Wear safety gear when necessary
• Disclose any medical conditions impacting their safety
• Stay in designated areas on the vessel

6.2 Restricted Items

The items below are not allowed onboard:

• Glass containers
• Illegal materials
• FIREARMS or any form of weapon
• Disproportionate amounts of beverages (beyond sensible consumption)
• Pets (unless granted permission before)

6.3 Behavior

Guests should behave in a respectable manner. We retain the authority to conclude a charter prematurely without a refund if the behavior of any party member threatens safety or interferes with the enjoyment of others.

7. Liability and Insurance

7.1 Limitation of Liability

We limit our liability to the cost paid for the yacht rental. We disclaim responsibility for:

• Injuries caused by a guest's carelessness
• Theft or harm to personal possessions
• Indirect, incidental, or punitive damages
• Delays due to weather or circumstances beyond our control

7.2 Insurance

We carry comprehensive marine insurance that encompasses our fleet and operations. Guests are accountable for their own travel and personal insurance coverage.

7.3 Risk Assumption

By taking part in our yacht charter, you acknowledge that nautical activities come with inherent hazards, and you assume responsibility for your safety and health.

8. Modifications and Itinerary Changes

We reserve the authority to alter itineraries, routes, or timetables depending on aspects like weather, safety, or operational needs. We will exert all possible effort to provide similar alternatives when adjustments are made.

9. Force Majeure

We are not answerable for hold-ups, suspensions, or alterations brought on by circumstances outside our control, including, but not restricted to:

• Extreme weather events
• Natural catastrophes
• Regulatory mandates
• Closure of harbors
• Technical failures

10. Privacy and Information Protection

We handle personal data in accordance with our Privacy Policy. By engaging with our services, you consent to the collection and use of your data as detailed in our Privacy Policy.

11. Intellectual Property Rights

The contents of our website, including texts, visual arts, logos, and pictures, are safeguarded by copyright and trademarks. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our written consent.

12. Applicable Laws
